In theory you should have a Scientific Collecting Permit from NSW Fisheries
which allows you to use non standard collecting methods like fine mesh nets.
This permit assumes a dead specimen in a jar on a museum shelf is the end
result of the collection. If by some chance you were able to catch fish by a
normal fishing method, such as on a hook or in a conventional legal bait
trap then that should be legal under a standard angling license as there are
no legal length restrictions for most species that you would want to keep in
a small aquarium. Of course this license assumes a dead fish on your plate
as the end result. The advantage of the scientific collecting permit is that
it is free and permits almost any collecting method. The advantage of the
angling license is that you can use it on weekends and don't have to inform
the local inspector. The advantage of ignoring the whole lot is that it is
free, but it can get a bit painful always looking over your shoulder.
The only thing that is clear in NSW is that you are under no circumstances
permitted to sell your catch without a (reasonably expensive and hard to
get) license.
The other thing that you may need is permission of the land owner or manager
to collect on their banks. In State Forests for example you should have a
special purposes permit which is free but which may only be granted if you
have whatever other licenses/permits/Animal Care and Ethics Approval are
deemed necessary for your methods (and if you haven't done anything to upset
the local foresters). If you are just pond dipping this would be minimal and
would be best sidestepped by going to the local SF office and asking if they
mind.
Most people just completely ignore the whole issue! In my experience the
only people penalised are those attempting to do the right thing. The
paperwork really sucks! Whatever you do, remember that fishing laws were not
designed for the fish watcher!
