STEELHEAD LISTING DECISIONS TO BE MADE 3/13TH

The National Marine Fisheries Service (NMFS) will be announcing its final
ESA listing decisions for the remaining Pacific coast steelhead populations
that it is undercourt order to determine but which were deferred for decision
on August11, 1997 and then again February 9th. The February 9th postponement
cited the need for delay so California could "develop its own recovery
plan" among other reasons -- a rationale which was not legally acceptable
to the Court overseeing the decision making process, and NMFS is now
under court order to make its decision by no later than 3/13th. These are
FINAL ESA listing decisions, as opposed to the additional proposed
listings for steelhead announced February 26th, which may or may not
result in additional action a year from now.
Under Court order, NMFS is now required to make its final ESA listing
decisions on the Central Valley ESU, the Northern California ESU, the
Klamath Mountain Province ESU, the Oregon Coast ESU and the Lower
Columbia River ESU.
It is rumored that NMFS will be deferring to the Oregon Salmon Recovery
Plan in classifying the Oregon Coast and Klamath Mountains Province
OR/CA transboundary ESU's into "candidate status" (i.e., refusing to list
them) but listing the others in some capacity. However, there has not yet
been a formal announcement. Oregon's Governor Kitzhaber and NMFS
Regional Director Will Stelle will also be holding a joint press conference
at that same time, expected to announce their deal to avoid listing, again
based on the Oregon Plan and its new "Steelhead Amendments."
NMFS will be having a briefing and announcement of its final steelhead
listing decision on these ESUs on Friday, March 13, 1998 from 10-11 AM,
to be held in the NMFS Portland Offices, 525 N.E. Oregon Street, Suite
500, Pacific Conference Room, 5th Floor, Portland, OR.
